Marriage/Spouse Visa

In Marriage visa you are allowed to take any type of work or employment without the need to have UK work permit.

Eligibility Criteria

For issuing marriage visa, candidate and the Partner, both must be at least 21 years old (or 18 years old if you or they are a serving member of HM Forces), and partner must be:

  • currently living and settled in the UK; or
  • returning to the UK with the candidate to live here permanently.

Candidate must show that:

  • They are legally married to each other or have registered a civil partnership;
  • They intend to live together permanently as husband and wife, or as civil partners;
  • They have met each other;
  • Your partner can support yourselves and any dependants without using public funds/benefits.
  • your partner has adequate accommodation where you and your dependants can live without help from public funds.

Duration/Extension

Marriage visa is initially issued for the period of two years. This is called Probation Period. After two years, if your relationship is still subsisting, you can extend your visa and apply for Indefinite Leave to Remain known as Permanent Residence. In some cases where person who has been married and living abroad with their spouse for four years at the time they apply for entry to the UK can be issued marriage visa to come to the UK permanently instead of two year.

Dependants

Children of the marriage who are under 18 years of age will be granted entry to the UK as dependants.

If you are under other categories like Tier 1, Tier 2 (Work Permit), Tier 4 (Student Visa) you can still bring your husband/wife or children as your dependants. They will be issued visa in line with your visa duration/limits.
