Right to Settlement/Indefinite Leave to Remain (ILR) is a permission to live in the U.K permanently without any time limit. You might be eligible to apply for settlement also know as permanent UK residency after you have spent a certain length of time in the U.K.(usually it is between 2 and 5 years) in some categories it might be 10 or 14 year (know as Long Residency rule)

Limits

there is not time limit you can stay in the U.K if you have got ILR. You can leave and re-enter U.K as many time as you wish. The main thing to keep in mind is you can not leave U.K for more than two year period at one point of time. You are expected to treat U.K as your main home. If you stay outside the U.K for longer period of time you may loss your ILR

Eligibility Criteria

Your right to apply for settlement will depend on your current immigration category. If you are on Marriage Visa, you can apply after two years. There are some other categories which lead to the Settlement like Tier 1, Tier 2 (work permit).

Time you need to spent under different categories:

• Ancestry (after 5 years)
• Highly Skilled workers :Tier 1/ Tier 2 or work permit holders (after 5 years)
• Marriage / Unmarried Partner (after 2 years)
• EU Nationals and their dependants (after 5 years)
• Long Residency (after 10 years as a legal resident or after 14 years as a combination of illegal and legal residency in the United Kingdom)

Most applicants will need to show that they have a Knowledge of English Language and life in the U.K. you may demonstrate this in two ways:

• Passing the ‘Life in the UK’ test, if they speak English to a reasonable standard; or
• Taking and passing a course in English and citizenship, if they do not speak English.
